Administration Abandons Immediate Unfair Dismissal Plan from Employee Protections Act
The government has decided to remove its central measure from the employee protections act, replacing the safeguard from wrongful termination from the commencement of work with a six-month minimum period.
Industry Concerns Prompt Policy Shift
The step comes after the business secretary addressed firms at a major gathering that he would heed worries about the consequences of the legislative amendment on recruitment. A worker organization insider remarked: “They’ve capitulated and there might be additional to come.”
Negotiated Settlement Agreed Upon
The worker federation said it was willing to agree to the compromise arrangement, after days of talks. “The primary focus now is to get these rights – like immediate sick leave pay – on the official legislation so that working people can start benefiting from them from April of next year,” its lead representative commented.
A worker representative explained that there was a perspective that the half-year qualifying period was more workable than the less clearly specified nine-month probation period, which will now be eliminated.
Governmental Backlash
However, MPs are likely to be concerned by what is a obvious departure of the government’s campaign promise, which had committed to “first-day” security against wrongful termination.
The recently appointed corporate affairs head has replaced the earlier incumbent, who had guided the act with the deputy prime minister.
On Monday, the official vowed to ensuring firms would not “lose” as a result of the modifications, which included a prohibition on zero-hour contracts and immediate safeguards for workers against unfair dismissal.
“I will not allow it to become zero-sum, [you] give one to the other, the other is disadvantaged … This has to be handled correctly,” he stated.
Bill Movement
A worker representative explained that the modifications had been approved to enable the legislation to move more quickly through the House of Lords, which had greatly slowed the bill. It will mean the minimum service period for wrongful termination being reduced from 730 days to six months.
The act had originally promised that timeframe would be eliminated completely and the administration had put forward a lighter touch trial phase that companies could use in its place, legally restricted to three quarters of a year. That will now be eliminated and the law will make it unfeasible for an employee to claim wrongful termination if they have been in post for fewer than 180 days.
Labor Compromises
Worker groups insisted they had achieved agreements, including on financial aspects, but the step is likely to anger radical MPs who viewed the worker protections legislation as one of their main pledges.
The act has been modified multiple times by rival lords in the Lords to satisfy key business demands. The official had declared he would do “whatever is necessary” to unblock parliamentary hold-ups to the legislation because of the upper house changes, before then reviewing its implementation.
“The voice of business, the voice of people who work in business, will be taken into account when we examine the specifics of enforcing those crucial components of the employment rights bill. And yes, I’m talking about zero hours contracts and immediate protections,” he said.
Opposition Criticism
The opposition leader labeled it “one more shameful backtrack”.
“The government talk about stability, but govern in chaos. No company can prepare, invest or recruit with this level of uncertainty affecting them.”
She added the legislation still included provisions that would “hurt firms and be harmful to economic expansion, and the critics will fight every single one. If the ministry won’t scrap the most damaging parts of this awful bill, we will. The state cannot build prosperity with growing administrative burdens.”
Ministry Announcement
The relevant department announced the result was the outcome of a compromise process. “The government was pleased to support these discussions and to set an example the merits of working together, and continues dedicated to keep discussing with worker groups, industry and companies to make working lives better, support businesses and, vitally, deliver economic growth and decent work generation,” it commented in a statement.
