US Court Orders Freedom of Abrego Garcia from Immigration Custody
A court has ordered the prompt discharge of Kilmar Abrego Garcia from detention by ICE, finding his ongoing detainment is without lawful basis.
"Since his return from erroneous imprisonment in El Salvador, he has been taken back into custody, again without lawful authority," the judge stated in her ruling.
The situation originates in a mistaken deportation to El Salvador earlier this year, which the government later acknowledged was an mistake. Following his return to the United States to answer alien smuggling allegations, he was detained in federal detention.
In her order, the judge noted that the government lacks a current removal order, which effectively blocks them from deporting Mr. Abrego Garcia "at this juncture."
